TERMS AND CONDITIONS
All orders for products sold by Di Moto Pty Ltd are covered by the following terms and conditions of sale:
Delivery
Delivery timeframes will be advised on placement of order. Timeframes are approximate, and are based on advice received from third-party shipping and handling services. Delivery is FOB. Di Moto Pty Ltd shall not be liable for delay in delivery, damage, or loss of goods once goods have been despatched. All risk of damage or loss of goods is assumed by the Purchaser once goods have been despatched.
Payment
Payment terms are strictly 30 days on delivery of goods. Di Moto Pty Ltd reserves the right to charge a late payment administration fee of 2% per month on all balances not paid by the Purchaser within the payment terms.
For Australian purchasers, GST (Goods and Services Tax) of 10% applies and will be quoted on the invoice. For overseas purchasers, FOB taxes and duties may apply regardless of whether they are included on the invoice, and as such, the Purchaser is responsible for collecting and/or paying all such taxes, or presenting tax exemption certificates to the relevant authorities.
Limitation of Warranty
Products sold to the Purchaser by Di Moto Pty Ltd or an authorised distributor are warranted by Di Moto Pty Ltd for a period of 12 months, commencing from the date of delivery. This warranty is non-assignable and non-transferable, and applies only to defects in materials and workmanship. Reasonable wear and tear, improper installation, operation or maintenance, and/or use of corrosive or abrasive materials does not constitute defect in materials or workmanship, and the warranty will not apply.
Liability under this warranty is limited, at Di Moto Pty Ltd’s option, to the replacement or repair of any defective materials. On repair or replacement of defective materials, Di Moto Pty Ltd’s warranty will continue for the remainder of the 12 month period for the original part. Under no circumstances will Di Moto Pty Ltd accept liability for loss of income, productivity or incidental damages as a result of repair or replacement of defective materials.
Returns
Cancellations of orders or return of conforming products are permitted only with the express approval of Di Moto Pty Ltd. The Purchaser will meet all costs (including, but not limited to, freight and insurance) of the return of defective products or parts to Di Moto Pty Ltd’s nominated delivery location. All goods must be returned new, unused, undamaged and sealed in the original packaging.
